Alex has been with Aitken Partners since 2008. He is a member of the firm’s Commercial Dispute Resolution team and has considerable experience in handling complex litigation as well as general commercial law.

Alex advises on disputes ranging from debt collection through to complex multi-jurisdictional commercial litigation and is able to give relevant and practical advice based on the best possible commercial outcomes for his clients.

He has appeared for clients in all State Courts as well as the Federal Court of Australia in areas such as general commercial litigation, debt recovery, insolvency, Trade Practices Act disputes and white collar crime. He is also confident accessing mediation services where appropriate and frankly assessing the risks to his clients.

Alex acts on behalf of a wide range of clients, from individuals experiencing litigation for the first time through to professional service firms who engage as litigants on a regular basis.  Alex’s ability to identify with his clients and adopt the appropriate strategy to achieve his clients’ individual objectives is a major strength of his practice.

His recent experience includes:

  • Acting for liquidators in a range of unfair preference claims in the construction and tiling industries;
  • Assisting in complex multi-jurisdictional Supreme Court litigation alleging breach of directors’ duties, unconscionability and undue influence;
  • Advising creditors in relation to their rights under the Corporations Act, specifically the right to recover a debt from the directors personally where insolvent trading can be proven;
  • A range of successful debt recovery actions on behalf of individuals and professional service firms in the Magistrates, County and Supreme Courts of Victoria;
  • Advising and appearing for both Applicants and Respondents in determining the validity of a Statutory Demand upon Application to the Supreme Court of Victoria.
