Anton is an experienced member of our Commercial Dispute Resolution team. Anton works in a wide range of matters ranging from commercial and planning disputes to contested estates and guardianship law. His expertise includes matters of competency and unconscionable dealings. Anton's broad experience enables him to provide balanced analysis of any given situation as well as objective and practical legal advice. While his preference is to provide pre-emptive advice to avoid cost and hassle, he is adept at negotiation, mediation and complex trials in several jurisdictions including a number of significant cross-border proceedings.

In light of his training and penchant for commercial matters, sciences and the arts, Anton delivers a range of insight for clients. Out of the office, he dedicates himself to the Australian International Opera Awards (of which he is a founding board member and director), the Opera School Melbourne and other charitable and pro bono endeavours. Anton is also a member of the Litigation section of the Law Institute of Victoria.

Administrative Law

Anton’s experience in administrative law includes advising:

  • unChain St Kilda (a not for profit organisation) in relation to its objections to the proposed Triangle Development Plan for the ‘St Kilda Triangle’ site – proceedings at the VCAT against Port Phillip City Council under s.149B of the Planning and Environment Act regarding development planning approval including issues of invalid approval, denial of natural justice, unreasonableness and acting ultra vires as well as several proceedings under FOI legislation.

General Commercial Law

Anton has advised and acted for a diverse range of public and private sector clients including:

  • a government statutory body and several individuals and businesses with respect of various intellectual property disputes including a dispute around a government website
  • the Melbourne Market Authority with respect to enforcement advice
  • a company and individuals in the purchase of restaurant and like businesses
  • general commercial advice to a large hardware wholesaler, a suburban chamber of commerce and a number of not for profit organisations.

General Litigation

Anton’s experience in General Litigation includes advising:

  • in general disputes (including provision of goods and services, sale of business, joint venture, insurance and debt disputes) for, among others: a software manufacture in a software licensing dispute, auctioneers, schools, pharmacists, international companies, innovative product manufacturers, a large fruit production co-operative, a salary packaging company, a corporate hardware wholesaler and retailer, a financial services firm, a corporate printing group, a national food and beverage group, an electronics wholesaler and distributor, a major transportation group, a film maker in dispute with an insurance company over a $6M film revenue insurance policy, a major grain producer and a NSW stock broking firm
  • a NSW Media Group with respect of revocation of an ABA licence
  • Supreme Court litigation on behalf of a family member where ownerships of assets of a multi-million dollar family business are in dispute
  • on product liability claims for a national machinery importer and distributor and a furniture retailer and its directors
  • a national firm of solicitors in a fee dispute with Government bodies
  • a large international company in dispute with banks and auditors arising from the fraudulent activities of its Australian subsidiary's directors
  • a number of individual clients involved in contractual disputes over the sale of businesses involving fraud and requiring injunctive relief preventing defendants from dealing with property.
  • large companies in civil proceedings against employees who perpetrated fraud and theft including injunctive relief preventing them from dealing with property
  • individuals, businesses and bodies corporate regarding disputes involving misleading and/or deceptive conduct and unconscionable conduct.

Freedom of Information and Privacy

Anton is well versed in Freedom of Information legislation and has extensive experience in advising and acting for individuals and organisations making or objecting to freedom of information requests including:

  • several FOI applications including obtaining building reports from the Australian Securities and Investments Commission, obtaining files from the department of Human Services concerning Adoption and Permanent Care Procedures, seeking a police reports and briefs relating to assault and battery by Victoria Police and also a civil compensation claim
  • several FOI objections including a law firm objecting to release of documents by Victoria Legal Aid, a client objecting to release of documents held by the Australian Prudential Regulation Authority, a client objecting to release of documents held by the Department of Innovation, Industry and Regional Development
  • a marketing company requiring privacy and general advice.

Property

Anton’s recent experience in property matters include acting for:

  • a developer in a planning application in VCAT for a development of a golf course accommodation facility at Phillip Island
  • landlords including rural landowners and corporate clients with CBD properties in tenancy disputes
  • tenants including a public company and a suburban chamber of commerce in tenancy disputes
  • Bodies Corporate (Owners Corporation), providing general advice and in disputes with builders
  • pro bono representation of an indigent and mentally incapacitated pensioner, represented by a court appointed administrator in recovering her home based on equitable principles
  • a developer in a negligence claim against a local council with respect of contaminated property
  • for several clients compulsorily acquisition matters.
