Rob is principal lawyer at Aitken Partners with more than 30 years' experience in property, equity and general commercial law and offers a wide range of expertise to clients. He sits on the Property Committee of the Law Institute of Victoria’s Property and Environmental Law section.

Rob’s commercial property experience includes working on industrial, commercial and major residential projects where he plays an active role in every step, including financing, acquisition, consolidation or subdivision, development, leasing or sale. Rob also has extensive planning experience representing permit applicants and objectors, both in their negotiations with responsible and referral authorities and before VCAT (and panels).

Due to Rob’s depth of knowledge of the property industry he also acts as a consultant to clients to deal with specific, unusual or complex property related matters such as covenant and easement removals. He also works closely with planners and his experience across the spectrum of property and planning issues enables him to think outside the square in terms of traditional legal advice, to help his clients achieve the optimum outcome.

In addition, Rob has given general commercial and business advice to a range of corporations in the manufacturing, retailing and services industries. He has experience in estate planning advice to high wealth individuals and advice and litigation in the fields of equities law to and for trustee companies and trading trusts. His practice also includes State taxation issues (land tax and stamp duty), town planning, valuations law, compulsory acquisitions and leasing.

Key experience

  • Advising on first mortgage securities for Victorian Mortgage Investments Limited and other lending institutions.
  • Advising clients on the removal of covenants on certificates of title.
  • Establishing the legal framework for Silverwater Resort at San Remo in Victoria – a 160 apartment holiday resort based on 399 year registered lease ‘titles’.
  • Acting on the acquisition, development, subdivision and sale of Brookes Gillespie House in Carlton – an 84 unit high rise student accommodation facility with on-site management.
  • Advising on the relocation of Frances Perry Private Hospital to the new Royal Women’s’ Hospital premises in Carlton.
  • Advising on the acquisition of the Windsor Hotel and subsequent appeal on a valuation for land tax purposes involving issues with regards to the hotel’s heritage listing.
  • Advising on the purchase and sale of petrol stations and car washes (including a recent sale of eight sites) and advice around the environmental issues.
  • Advising the University of Ballarat with regards to certificates of title.
  • Advising on the Victorian Law Reform Commission’s report on the easement of covenants as a member of a sub-committee of the Law Institute of Property and Environmental Law section.
