Experience

Amy is an Associate in the Wills and Estates team, practising in estate litigation, estate administration and estate planning. She has worked in both mid-tier and boutique law firms, developing experience across a broad range of wills and estates matters.

Amy appreciates the sensitive nature of wills and estates matters and is committed to ensuring her clients feel comfortable, informed and supported at every stage. She works closely with individuals and families to understand their unique circumstances and deliver tailored, practical solutions that provide clarity and confidence throughout the legal process.

Expertise

Amy’s expertise includes the following:

Estate litigation

  • Issuing and defending family provision claims (testator family maintenance claims or Part IV Claims).
  • Issuing and defending applications for the removal of an executor/administrator.
  • Issuing and defending applications regarding the validity of a Will.
  • Trust disputes and superannuation disputes involving death benefits.
  • VCAT disputes such as guardianship and administration applications.

Estate administration

  • Applying for Grants of Representation (including Probate and Letters of Administration).
  • Advising on and attending to the administration of estates.
  • Advising executors and administrators of their duties and obligations.
  • Advising beneficiaries of their rights and entitlements.

Estate planning

  • Preparing Wills, including simple Wills and more complex Wills incorporating testamentary trusts.
  • Preparing enduring powers of attorney and appointments of medical treatment decision makers.
  • Preparing superannuation binding death benefit nominations.
  • Advising on successions of trusts, companies and self-managed superannuation funds.
  • Advising on the rights and obligations of an attorney pursuant to an enduring power of attorney.
