Mickleham Road Upgrade - Stage 1

Compulsory Acquisition: 26 October 2022

On 12 October 2022, the Secretary to the Department of Transport ('the Authority') published a Designation of the Project Area for a Declared Project ('declared project area') in the Victoria Government Gazette which included a map identifying the land which is required for the Mickleham Road Upgrade - Stage 1 Project between Somerton Road and Dellamore Boulevard in Greenvale.

Stage 1 of the Mickleham Road Upgrade involves:

  • Duplication of Mickleham Road in both directions between Somerton Road and Dellamore Boulevard;
  • Adding traffic lights at Aitken College;
  • Replacing the roundabout at Somerton Road and Mickleham Road with a new traffic light intersection;
  • Upgrading the Hillview Road and Dellamore Boulevard intersections; and,
  • Building new sections of walking and cycling paths to improve connectivity along Mickleham Road.

Now that the Authority has declared the project area and the land required for the Mickleham Road Upgrade - Stage 1 Project, the compulsory acquisition process is able to start. The compulsory acquisition process will start by the Authority serving the first formal notice in the process, namely a Notice of Intention to Acquire ('NOITA').

It is important to seek independent expert legal advice to ensure that you understand the effect that the compulsory acquisition will have on your land and to ensure you are in the best position to claim all that you are entitled to from the Authority once the compulsory acquisition process begins. The compulsory acquisition process can be complex and both landowners and tenants have potential rights to claim compensation.

We would be happy to meet with you on a free, no obligation basis to discuss the compulsory acquisition process and your legal rights to compensation.
