Reports today of the Sydney Swans declaring a contracted assistant coach off-limits has a legal base for the club to defends its position.
If Stuart Dew as the coach in question decided to leave the Swans for Melbourne as report in The Age, the Swans could apply for an injunction to stop him from leaving and sue him for specific performance of the contract. Alternatively, it could accept his breach and sue him for breach of the employment contract to recover any financial losses incurred by reason of his departure.
